Preventing Illegal Employment

Since 2008, employers have been given a greater role in detecting and preventing illegal employment. Employers that fail to detect and prevent illegal employment face fines of up to £10,000 per illegal employment.

Illegal employment is not limited to someone who is in the country illegally. Illegal employment addresses issues such as:

1. Is the person legally present in the UK?
2. Although the person is legally present in the UK, is the person legally able to work in the UK?
3. Although the person is legally eligible to work in the UK, is the person working more hours than he is able to work?
4. Is the person getting paid at least the minimum wage?

At Miles Pierce, we will help employers create a HR System that will prevent and detect illegal employment. The HR System depends on the size of the company and the number of employees. The categories of employees are subdivided into three categories. They are:

1. Number of EU employees
2. Number of non-EU employees
3. Number of employees sponsored by the company

For an annual fee, we will create and implement the HR System. We will also update and train HR on how to detect and prevent illegal employment.
