The K1 Fiancé Visa allows US Citizens to sponsor their foreign fiancées to travel to the US to get married in the US and apply for Permanent Residency. The US Citizen is the K1 Fiance Visa applicant and the foreign national is the beneficiary of the K1 Fiance Visa.
The K1 Fiancee Visa application has two stages. In the first stage, US Citizen makes the K1 Fiancee Visa application to the USCIS. Once the K1 Fiancee Visa application has been approved, the approved K1 Fiance Visa is transferred to the appropriate US Embassy. At this stage, the beneficiary of the K1 Fiancee Visa will go to the US Embassy for an interview.
The US Citizen fiancée applying for the K1 Fiancee Visa must establish that the relationship is bona fide. Once the K1 Fiance Visa application is approved, the Embassy will interview the beneficiary of the K1 Fiancee Visa application to determine the beneficiary’s eligibility to travel to the US under the K1 Fiance Visa. Some of the factors the Embassy will take into account are previous violations of US Immigration Laws, Health issues and the US National’s ability to support the applicant and any dependants.
The US Citizen must demonstrate the ability to support the foreign national and any dependants. The minimum salary requirement is determined on annual basis. The person must show an income equivalent to 125% of the National Poverty Guidelines. When determining the necessary income, all the dependants are taken into account. The US Citizen may obtain assistance from family members to show the ability to support the foreign national.
Once arriving in the US on the K1 Fiance Visa, the holder of the K1 Fiance visa must marry the US Citizen within 90 days of arriving in the US under the K1 Fiance Visa.
After getting married, the holder of the K1 Fiancee Visa needs to apply to the USCIS for an Adjustment of Status and Employment Authorization. The foreign national holding the K1 Fiancee Visa cannot work in the US until receiving the Employment Authorization.
The K1 Fiancee Visa is a non-immigrant visa. The K1 Fiance Visa, itself, does not give the visa holder a Permanent Resident Card, (commonly known as the Green Card). The K1 Fiance Visa is simply a means to getting the Green Card.
Any children of the foreign fiancée can join come to the US as a dependant of K1 Fiancee Visa applicant, providing the children are minors
